{"id":2132,"date":"2021-10-04T10:54:31","date_gmt":"2021-10-04T09:54:31","guid":{"rendered":"https:\/\/new.contentdeployment.co.uk\/tomd\/?p=2132"},"modified":"2021-10-06T10:55:37","modified_gmt":"2021-10-06T09:55:37","slug":"lpa-overhaul-consultation-launched","status":"publish","type":"post","link":"https:\/\/new.contentdeployment.co.uk\/tomd\/2021\/10\/04\/lpa-overhaul-consultation-launched\/","title":{"rendered":"LPA overhaul? \u2013 consultation launched"},"content":{"rendered":"<div class=\"hd-block hd-block-paragraph\">\n<p><strong>During the summer, the Ministry of Justice launched a 12-week\nconsultation into the process of registering and creating a Lasting Power of\nAttorney (LPA).<\/strong><\/p>\n<\/div>\n\n<div class=\"hd-block hd-block-paragraph\">\n<p>A handy component of intergenerational wealth planning, LPAs are\nlegal documents, introduced in 2007 to replace the Enduring Power of Attorney,\nthat allow one person (the <em>\u2018donor\u2019<\/em>) to appoint another (the <em>\u2018attorney\u2019<\/em>)\nto manage their finances and\/or general health and welfare. Questions have\narisen in recent years, as to the system\u2019s fitness for purpose. Also, concerns\nthat unscrupulous relatives may be abusing the system to gain access to their\nelderly victims\u2019 wealth, have arisen.<\/p>\n<\/div>\n\n<div class=\"hd-block hd-block-paragraph\">\n<p><strong>Time for tech<\/strong><\/p>\n<\/div>\n\n<div class=\"hd-block hd-block-paragraph\">\n<p>The Ministry of Justice commented, <em>\u2018The number of registered\nLasting Powers of Attorney (LPA) has increased drastically in recent years to\nmore than five million, but the process of making one retains many paper-based\nfeatures that are over 30 years old\u2026 The consultation will look at how\ntechnology can be used to reform the process of witnessing, improve access and\nspeed up the service.\u2019<\/em><\/p>\n<\/div>\n\n<div class=\"hd-block hd-block-paragraph\">\n<p>With the consultation closing in mid-October, the government\nintends to publish a response in January 2022.<\/p>\n<\/div>\n\n<div class=\"hd-block hd-block-paragraph\">\n<p><strong><em>The value\nof investments and income from them may go down.
